Depending on the eviction laws in Maryland will determine what can be done to you. The only thing you have going presently is the bank, at this time, does not own the property. The current owner gave those on the lease permission to stay there rent free, though I can not figure out why he would do that. You are not on the lease therefore do not really have permission to stay there. All lenders decide when to place a property in foreclosure based on their policy. So some might immediately place a property in foreclosure when a borrower miss his first payment while others might wait in excess of 6-9 months. Once the property has been placed in foreclosure a document will be sent to the property indicating that the property is currently in foreclosure. Once that document is received normally the borrower have 120 days in which to bring the mortgage current. Failure to bring the mortgage current after 90 days have elapsed, the lender could then send a "Notice of Sale" Again the lender makes the policy so some send this notice out immediately when the 90 days have expired while others might not send this document for a few weeks of perhaps a month. This document set the date, time and place where the property will be sold. Once the borrower receive this document there are approximately 20 days before the actual sale. At the sale if some one has been successful in purchasing the property, once all the documents have been signed transferring the property to the new owner, then the new owner will contact you about a move out date. If the property does not sell, the lender still have to get the property legally transferred to them so once this is done, the lender normally hire a real estate broker to sell the property and represent them with all matters involved in the property so a representative will contact you about when you are expected to move. If you fail to move on the day you agree to move then an eviction notice will be served on you by the local marshal or sheriff or what ever law enforcement agency handle evictions in your county. Social Security benefits are usually exept from creditor attachment and that exemption passes to the deposited SS benefits in the bank account. So seizure through a bank account should not happen. However, after a judgment, some creditors will try to seize SS monies in a bank account, by requiring the bank to freeze your account. You will then be forced to file a motion with the court who granted the judgement, requesting to have your "exempt" SS monies released. It can be a long process. If there is a concern of any type of financial judgment against you, it would be wise to have your SS benefits deposited to a bank account with no commingling of funds from any other source, i.e., the bank account is only for your SS retirement benefits. This will help protect your SS benefits from being frozen in account that commingles exempt and non-exempt funds.

If your landlord refuses to pay back the deposit then he is breaking the law and can get fined, i recentley recived my deposit back from a nightmare landlord that made me cry several times, the strees and disscomfort this caused was giving me problems too with my health. I contacted Tenant Deposit help on 0845 4678803 they reasured me the landlord was in the wrong and ffive weeks later i recived a cheque for the full deposit plus an appology from the landlord! i`ve no idea what this firm of lawyers did but they must have shook him in his boots! the contact for the lawyer is hen...@lawyer.com.

Yes they can collect the rent and the pay or quit notice is the start of this process. If you have not paid rent at the end of the five days they will start the eviction process. They basically have told you they no longer wish to rent to you after 90 days so you will have to pay all that is due or you will be looking for a new place on the courts terms. Good luck to you.

If the law where states about ` common law` you would have to ask the state where you live about that, but in most you can`t kick that person out in to the street if they have been living there over more then three 3mos, okay You would to do a eviction just like a landlord would check the State law.

No. You can`t come back claiming anything if it was never part of an agreement. If i borrowed money from a bank and put it on a house, car etc, and pay them back. they cant come back and say they own my car or house cuz they lended me the money.

I recieved a seven day nottice to quit, if i move out and my landlord keeps my 500 $ security which is the same as my rent. do i still owe him 500 more? and if he already got his rent by keeping my security can he take me to court?

I would leave the lease and find an affordable place. I know sometimes it easier said than done but It sounds like your between a rock and a hard place. Good luck!
